BAR HARBOR — Developer Bob Bond’s plans to subdivide 25 acres of land at the intersection of Seabury Drive and Route 3 were struck down by the board of appeals earlier this month.
The subdivision plans, which call for seven lots on the land, had been approved by the planning board in February of this year. Soon after, Seabury Drive resident Greg Moore appealed the ruling. Mr. Moore has been fighting Mr. Bond’s attempts to subdivide the property for several years, and has successfully appealed previous approvals.
Mr. Moore’s latest appeal spanned four categories and 28 arguments and unsupported findings. On many of these, appeals board members denied Mr. Moore’s claims and sided with the planning board.
Where they did find support for Mr. Moore’s arguments were largely road related. Mr. Bond will not use Seabury Drive to access the subdivision. The road he intends to build was found to be too close to forested wetlands on the property. Also, a question of whether the road intersects with Route 3 too close to other roads in the area needs to be clearly answered.
